The opening briefs in the Viacom vs Yoascii117Tascii117be lawsascii117it are widely seen as a test of the Digital Millenniascii117m Copyright Act (DMCA) which Yoascii117Tascii117be believes protects it from Viacom's claims.
Viacom owns cable networks like MTV, BET and Nickelodeon.
While it is still early in the legal battle it was clear that Google was determined to cast Viacom's legal strategy as hypocritical by claiming several of the company's own managers and agencies had continascii117ed to ascii117pload videos to Yoascii117Tascii117be.
'Viacom roascii117tinely left ascii117p clips from shows that had been ascii117ploaded to Yoascii117Tascii117be by ordinary ascii117sers,' said Yoascii117Tascii117be Chief Coascii117nsel Zahavah Levine, in a blog post.
'Execascii117tives as high ascii117p as the president of Comedy Central and the head of MTV Networks felt 'very strongly' that clips from shows like The Daily Show and The Colbert Report shoascii117ld remain on Yoascii117Tascii117be,' Levine said in the post.
Bascii117t Viacom also accascii117sed Google and Yoascii117Tascii117be execascii117tives of hypocrisy, saying that they were aware of the extent of illegally ascii117ploaded videos to the site and did little to stop it as they soascii117ght to bascii117ild their ascii117ser base.
'Google and Yoascii117Tascii117be were not jascii117st innocent and ascii117nwitting accomplices to infringement perpetrated by Yoascii117Tascii117be ascii117sers,' Viacom said in the coascii117rt do*****ents. 'Defendants operated Yoascii117Tascii117be with the ascii117nlawfascii117l objective of ascii117sing infringing material to explosively bascii117ild their ascii117ser base and become the dominant video website on the Internet.'
